Jigra Makers Win Trademark Dispute Case; Alia Bhatt’s Starrer Will Be Screened In Jodhpur, Rajasthan As Court Lifts Stay Order

The Rajasthan High Court has lifted a stay order on Alia Bhatt‘s film Jigra, allowing it to be screened in Jodhpur. This decision comes after a lower court had previously halted the film’s release due to a trademark dispute raised by a petitioner.

With the court’s ruling, Jigra will screen there too on its release day today, Friday, October 11.

Rajasthan Court Lifts Stay On Jigra, Says It Didn’t Violate Trademark Rights

A bench of Justices Pushpendra Singh Bhati and Munnuri Laxman stated their initial belief that the film’s title does not infringe upon the trademark rights of Bhallaram Choudhary.

The judges pointed out that Jigra is produced by Dharma Productions and does not trade under that name. They noted, “Moreover, the appellant is not trading in the name of Jigra, rather it is M/s. Dharma Production Private Limited. Thus, the goods and services rendered by Dharma Production Private Limited by naming a movie as Jigra cannot be said to be an infringement of trademark laws.”

The court further indicated that if any infringement were found, the petitioner could seek monetary compensation or other appropriate remedies.

Choudhary’s petition argued that he operates an online class named Jigra and obtained a trademark for it in September 2023 under The Trade Marks Act, 1999. This trademark is classified under Class 41, which encompasses education, entertainment, and training services.

In response, Dharma Productions contended that Choudhary’s business does not intersect with the film industry, making the claim of trademark infringement unfounded.
