Ahead Of Retirement, Bombay High Court Judge Couldn’t Complete Writing Salman Khan Defamation Verdict, Set To Be Heard By New Judge

Justice CV Bhadang reserved the verdict on Khan’s appeal after hearing the matter for a certain period. Justice Bhadang is set to exit office on November 4. Today, he told counsel that he couldn’t accomplish writing the judgment since he got busy with some administrative work and other activities. The matter will be heard by a new judge.

“Unfortunately I am unable to complete the judgement. I tried my level best till last evening also. But unfortunately there was vacation and then administrative work, and I had other assignments. I will have to list this as part heard. I understand the apprehension of the parties and that substantial time and efforts went into this. I would have loved to decide this case either way. Unfortunately this came at the fag end of my career. I will list this as part heard and then this will come up for hearing post vacation,” stated the judge while apologising to respective parties.

Khan filed a civil suit before the City Civil Court in Mumbai in 2021 claiming that his neighbour Kakkad made “false, disparaging and defamatory allegations” in videos, posts and tweets leading to a wrong impression of Khan, his family members, including his business ventures.

He asked for injunctive reliefs against the defendants, besides Kakkad, other individuals and social media platforms like Twitter, Facebook, Google, YouTube and their Indian counterparts. The Mumbai court in March, 2022, dismissed the application for interim relief.

There was documentary evidence to suggest allegations made against Khan relating to illegal encroachment and violation of the Forest Act. Meanwhile, Advocates Abha Singh and Aditya Pratap Singh for Kakkad stated that his statements were around facts about Khan’s property and therefore did not lead to defamation.
