The Supreme Court has made a significant decision regarding a complaint against Yash Raj Films concerning the exclusion of a song from the movie Fan. The bench of justices PS Narsimha and Aravind Kumar delved into the legal complexities surrounding customer-provider relationships in promotional activities.
The case stemmed from a complaint by Afreen Fatima Zaidi, who, after watching promos of the film featuring the song Jabra Fan, found the song missing from the actual movie. Seeking compensation and a directive to air promos with a disclaimer about the song’s exclusion, Zaidi’s complaint triggered a legal battle.

Yash Raj Films argued that Zaidi wasn’t a consumer and that the song’s absence had been publicly disclosed before the movie’s release. Despite initial dismissals of her plea, the Maharashtra Consumer Commission ruled in Zaidi’s favour in 2017, ordering the production house to compensate her with Rs 10,000 and cover litigation costs of Rs 5,000.
The National Consumer Disputes Redressal Commission (NCDRC) supported Zaidi’s claim, deeming the exclusion of the song after its prominent promotion as an unfair trade practice. The Commission rejected Yash Raj’s argument that public disclosure sufficed, emphasizing that not all viewers of the promos would have seen subsequent clarifications.

Moreover, the NCDRC questioned the discrepancy between including the song in the trailer and omitting it from the film’s theatrical release, hinting at potential audience deception.
