The Delhi High Court on Tuesday restrained rogue websites, cable tv platforms, direct to home services as well as ‘John Doe’ defendants from committing copyright infringement of the upcoming Shah Rukh Khan movie, Jawan.
Justice C Hari Shankar passed the order today after a suit was filed by Red Chillies Entertainment Private Limited, the production house owned by Shah Rukh Khan and Gauri Khan.
The Court in its order also directed social media platforms like YouTube, Google, Twitter and Reddit to take steps to stop circulation of the copyrighted content of the movie.
Justice Hari Shankar further ordered various internet service providers to block access to the websites displaying or making available for viewing or downloading the content of the movie.
The film is set to be released in theatres on June 2.
Red Chillies Entertainment approached the High Court stating that two video clips related to the film have been leaked on social media platforms.
The first clip shows a fight sequence involving Khan. The second clip was of a dance sequence involving Shah Rukh Khan and the Film’s female lead actor, Nayanthara.
“It is the plaintiff’s (Red Chillies) case that these Leaked video clips are nothing but clear violation of copyright/intellectual property rights of plaintiff which are are causing damage and loss to the plaintiff. The leaked video clips together give away the look of the actors in the said film, as well as the music, both of which are typically disclosed at strategic points in time as part of the carefully curated marketing strategy of a film,” the Court was told.
The suit further said that there are certain photographs/stills that have been leaked by defendants from the set of the film when it was being shot in the studios behind closed doors.
An apprehension was expressed that the rogue social media handles would further copy, reproduce and distribute the copyright protected materials and other proprietary information on various platforms.
“The plaintiff reasonably apprehends that such publication and unauthorized circulation of the leaked video clips and said film will jeopardize the promotion and exploitation rights of the plaintiff in the said film and as and when the said film is released in theatres, similar acts of piracy relating to the entire Film would also commence and intermediaries / websites as described would again be utilized to illegally copy, record, download, reproduce, transmit and communicate the said copyright protected work to the general public.”
After considering the case, the judge passed the interim order. Red Chillies was represented by a team of DSK Legal comprising Parag Khandhar, Partner and Chandrima Mitra, Partner. They were assisted by advocate Krishan Kumar. Senior Advocate Rajshekhar Rao along with along with advocate Nizamuddin Pasha argued the case.
Speculations Over Release Date Of Shah Rukh Khan’s Jawan Continues
Shah Rukh Khan‘s upcoming film, Jawan, directed by Atlee, is set to release on June 2, 2023. The film is an action thriller that stars Shah Rukh Khan, Vijay Sethupathi, Nayanthara, and Riddhi Dogra. The principal photography for the film began in September 2021 and ended in April 2023. The film’s promotions are set to begin in early May, with a tight 4-5 week promotional campaign as per unconfirmed unofficial reports. The makers are planning to release the promo of the film in the first week of May, followed by the trailer and songs as per reports.
Shah Rukh Khan has been actively promoting his films, and he has been successful in creating a buzz around them. With the mega success of Pathaan, Shah Rukh Khan has yet again proved that he is a true genius when it comes to promoting a film and serving content that caters best to the current trend and audiences. Shah Rukh Khan announced Jawanin 2022, which is going to be a vigilante thriller and features some of the top talents from the Southern film industry.
The postponement of Yodha and Dream Girl 2 in last two days from 7th July to different dates has fuelled rumours around Rocky Aur Rani Ki Prem Kahani and Jawan. Off the record, sources from both the production houses have confirmed that respective films will hit cinemas as per schedule.
Though trade is full of buzz around reschedule dates of both the films. It’s uncanny that both the 7th July releases were earlier too shifted their release dates for different reasons and shifting these dates again need to have a solid reason behind.
As per sources close to a special effect and post production studio, “Jawan makers are trying best to release on 2nd June but no way the post production work can be completed before 20-25th May. So they might push film only by couple of weeks to 29th June which is extended 4 day Eid weekend. It will also give good 7-8 weeks for promotion.”
